Recreation Northwest Classes & Tours Waiver
I, the purchaser, agree to this release of all claims, waiver of liability, and assumption of risk (“Waiver and Release”). I waive any and all claims I may have now and in the future, and release from all liability, and agree not to sue Recreation Northwest., its officers, agents, representatives, employees, or tour guides [hereafter referred to as “Staff”] for any personal injury, death, property damage, or loss sustained by me as a result of my participation in “Classes & Tours” due to any cause whatsoever, including without limitation, negligence on the part of Recreation Northwest, its Staff, tour partners, or other participants, or death or injury as a result of war, civil unrest or epidemic. I further agree that if I violate this agreement and attempt to bring suit against any part of the parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action.
I am aware that the experience, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared and weather extremes subject to sudden and unexpected change. I accept all the inherent risks of the proposed clinic or tour and the possibility of personal injury, death or property damage, or loss resulting from. I acknowledge that the enjoyment and excitement of the proposed form of the tour are derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness Recreation Northwest or its Staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety.
I understand that photographs, video, or digital likeness took on this tour may be used as a worldwide, royalty-free license solely for promotional, educational, and/or commercial purposes. If I do not wish to have my photograph, video, or digital likeness taken on the tour or used for commercial purposes, I understand that I need to inform staff prior to or at the time of arrival of the class or tour.
Further, I agree at all times during the tour, to abide by and comply with any additional instructions given by my tour guide or any other Staff and I accept that non-compliance may result in injury, death, or permanent disability. I understand that non-compliance may result in my removal from the class or tour.
In entering this Waiver and Release, I am not relying on any oral, written nor visual representations or statements by Recreation Northwest or its Staff or any other inducement or coercion to go on the tour. I confirm that, by my own free will, I have read and understood the Terms and Conditions of this tour and Waiver and Release prior to signing it and agree that this Waiver and Release will be binding upon my heirs, next of kin, executors, administrators, and successors.
As a participant on the tour, I accept full responsibility for my behavior, well being, and health throughout the tour, which may involve a variety of activities, unfamiliar locations, and modes of travel, including but not limited to: climbing stairs, riding a bike, stand up paddleboard. I further realize that the tour may involve walking through unfamiliar, narrow, and/or steep corridors, gangways, roads, stairways, and driveways.
Even with the precautions our organization, staff, and participants take to minimize social contact, there is still the possibility that you may come in contact with someone who is ill or you may become ill yourself. If you begin to demonstrate symptoms of illness (as noted on the Center for Disease Control website), you may be asked to leave your trip, and/or your trip may be terminated early. You are responsible for any additional expenses incurred due to self-quarantining or becoming ill, including but not limited to: Additional nights of lodging, flight or reservation change fees, and/or any further medical care including testing costs.
As a participant on this class or tour, I acknowledge and understand that maintaining the current health department requirements for the specific phase or state mandate for COVID is vital to keeping everyone healthy and safe. I agree, to follow the current guidelines. I also understand that all Staff has been vaccinated for COVID-19 and may remove their mask to provide instruction to the group and will aim to maintain a distance of six feet between themselves and others.
Traditional Cardio-Pulmonary Resuscitation (CPR) requires a rescuer to place their mouth over the patient’s mouth to provide rescue breaths, while also providing chest compressions to keep the heart beating. This places the rescuer in harm’s way if the patient has COVID-19 or any other communicable disease. In accordance with The American Heart Association guidelines, Recreation Northwest staff are not required to provide rescue breathing during an incident that requires CPR due to the risk associated with your activity. Staff is trained to call 911 and provide chest compressions to keep the heart beating.
If you choose to not follow these guidelines, cannot make the above affirmations, or falsify any information regarding COVID-19 and your health, you acknowledge that you will not be allowed to participate and may be expelled from your scheduled class or tour.
By agreeing to participate in this class or tour you affirm that:
- You have been practicing social distancing, wearing proper personal protection including masks in work, public and social settings.
- You are not prematurely leaving a 14-day quarantine, or after receiving a positive COVID test, to attend your scheduled tour, and you have had no known or obvious exposure to someone with COVID-19 in the past two weeks.
- You do not currently present with symptoms of infection.
